Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Roostie website at roostie.app and the Roostie hotel price-tracking service (together, the "Service"). The Service is operated by Importify Limited, a company registered in Hong Kong ("Roostie", "we", "us", or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Roostie is an informational tool that monitors the prices of hotels you choose, for the dates you choose, across third-party booking sites, and notifies you when it detects a notable price change. Roostie is not a travel agency, tour operator, or booking platform. We do not sell, supply, or take payment for hotel stays, and we are not a party to any booking you make. All reservations are made directly with the relevant online travel agency or hotel under their own terms.

2. Eligibility and accounts

You must be at least 16 years old to use the Service. If you create an account, you are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your credentials and any activity under your account. Notify us promptly of any unauthorized use.

3. Price information and accuracy

We do not guarantee that any price, deal, or alert is accurate, available, or that you will be able to book at a price shown. The Service is provided to help you decide when to check a booking site — the booking site is always the source of truth.

5. Third-party sites and bookings

The Service contains links to third-party websites and services that we do not own or control. We are not responsible for their content, products, prices, availability, terms, or privacy practices. When you follow a link and book, your transaction is solely between you and that third party, and their terms and policies apply. Any disputes regarding a booking, payment, cancellation, or refund must be resolved with that third party.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Copy, scrape, resell, or redistribute data from the Service, or use it to build a competing product;
• Interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service or its systems;
• Use automated means to access the Service except as we expressly permit.

7. Intellectual property

The Service, including its name, logo, design, text, and software, is owned by Importify Limited or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial purposes. All rights not expressly granted are reserved.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that prices, alerts, or other information will be accurate or complete.

9. Limitation of liability

To the fullest extent permitted by law, Importify Limited and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, savings, data, or bookings, arising out of or related to your use of (or inability to use) the Service, even if advised of the possibility. To the extent we are found liable, our total aggregate liability will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or USD 50.

10. Indemnification

You agree to indemnify and hold harmless Importify Limited and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service or your breach of these Terms.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.

12. Changes

We may modify the Service or these Terms from time to time. When we change these Terms, we will update the "Last updated" date above. Material changes will take effect when posted, and your continued use of the Service constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-laws rules. You and Importify Limited submit to the exclusive jurisdiction of the courts of Hong Kong for any dispute arising out of or relating to these Terms or the Service.
